CLIENT TRAVEL AGREEMENT & TERMS AND CONDITIONS

An Independent Contractor of Cruises and Tours Unlimited DBA Fit For a Star Travel

PLEASE READ THIS AGREEMENT CAREFULLY BEFORE MAKING ANY PAYMENT OR BOOKING. By making payment to Fit For a Star Travel, LLC (hereinafter “Fit For a Star Travel” or “Agency”), you, the booking passenger, acknowledge that you have read, understood, and agree to be legally bound by all of the following terms and conditions. These conditions apply to yourself, your family members, and any traveling companions on whose behalf you make payments or representations.

Fit For a Star Travel, LLC operates as an independent contractor of Cruises and Tours Unlimited DBA Fit For a Star Travel, and serves as a retail travel agency providing sales and coordination services for travel products offered by third-party suppliers.

1. AGENCY ROLE & LIMITATION OF LIABILITY

Fit For a Star Travel offers retail travel services to clients, which are provided by separate and independent vendors of travel services. We do not operate, control, or otherwise provide the services of independent travel vendors. Fit For a Star Travel acts only as a sales agent for any airline, hotel, car-rental company, ground operator, tour operator, cruise line, shore excursion, attraction, or other travel Supplier who provides goods or services for the passenger’s trip.

While Fit For a Star Travel prides itself on selecting top-quality Suppliers, we assume no responsibility for and shall not be liable for any refund, personal injury, property damage, or other loss, accident, delay, inconvenience, or irregularity which may be caused by: (1) any defaults, wrongful or negligent acts, or omissions of the Suppliers; (2) any defect in or failure of any vehicle, craft, equipment, or instrumentality owned, operated, or otherwise used or provided by the Suppliers; or (3) any wrongful or negligent acts or omissions on the part of any other party not under our control. Suppliers reserve the right to deviate from the direct, customary, and/or scheduled route or itinerary for any reason, without limitation and without notice. Passenger(s) acknowledge and agree that Fit For a Star Travel is not responsible for Supplier deviations, delays, cancellations, mandated overnight stays, missed connections, or any other condition beyond its control.

2. FORCE MAJEURE

“Force Majeure” means any circumstances beyond the reasonable control of Fit For a Star Travel, including but not limited to: acts of God, explosion, flood, forceful wind, fire, accident, war or threat of war (declared or undeclared), acts of terrorism, sabotage, riots, strikes, civil disturbance, requisition, sickness, epidemic or pandemic, quarantine, government intervention, travel bans, border closures, weather conditions, defects in machinery and vehicles, wildlife, or other untoward occurrences. Fit For a Star Travel shall not be liable for any loss or damage incurred by you as a consequence of any Supplier being unable to perform its obligations due to a force majeure event beyond the reasonable control of the party affected.

3. PRICING, ERRORS & SUPPLIER CONTRACTS

Passenger(s) acknowledge and understand that cruise lines, tour operators, and other Suppliers have their own contracts covering cancellation penalties and other terms and conditions, and that you may be bound by those contracts regardless of whether you receive notice of their terms. Pricing and availability may change without notice. Passenger(s) agree that Fit For a Star Travel is not responsible for any errors or omissions in any quotes or advertisements, including on our website, resulting in inventory, content, or pricing discrepancies, nor is Fit For a Star Travel responsible for any errors or omissions that may occur as a result of incorrect information from third parties. Suppliers reserve the right not to honor any published prices that they determine were erroneous due to electronic, printing, or clerical error. You acknowledge this right and agree to hold Fit For a Star Travel harmless for any actions or damages arising from Supplier pricing.

Prices are not subject to increase after you make full payment; however, a price increase may apply due to changes in: transportation costs (e.g., fuel surcharges), scheduled airfares and other airline surcharges, government actions such as increases in VAT or other government-imposed increases, or currency exchange rate fluctuations. Passenger(s) acknowledge and consent to any post-purchase price increases in relation to the above.

4. NON-REFUNDABLE RATES, DEPOSITS & CANCELLATION PENALTIES

IMPORTANT NOTICE REGARDING NON-REFUNDABLE BOOKINGS: Certain rates, fares, promotional pricing, and packages offered by Suppliers are designated as strictly NON-REFUNDABLE and NON-TRANSFERABLE at the time of booking. By selecting and purchasing a non-refundable rate, the passenger(s) expressly acknowledge and agree to all of the following:

(a) Non-Refundable Rate Acknowledgment. Passenger(s) understand that a non-refundable rate means that no monetary refund, credit, or compensation of any kind will be issued by the Supplier or by Fit For a Star Travel under any circumstances, including but not limited to: voluntary cancellation, illness, injury, family emergency, work conflict, weather, or any other reason not specifically covered under a purchased travel insurance policy.

(b) Deposit Non-Refundability. Any deposit paid at the time of booking may be non-refundable as dictated by the Supplier’s terms. Passenger(s) acknowledge that such deposits are applied immediately toward the booking and may be fully forfeited upon cancellation at any point after payment.

(c) Passenger Responsibility. It is the sole responsibility of the passenger(s) to review and understand all cancellation policies, penalty schedules, and refund terms provided by the Supplier at the time of booking. Fit For a Star Travel will make reasonable efforts to communicate such policies; however, the ultimate responsibility lies with the passenger(s) to read and understand all documentation provided.

(d) No Chargeback on Non-Refundable Rates. PASSENGER(S) EXPRESSLY AGREE THAT THEY WILL NOT INITIATE A CREDIT CARD CHARGEBACK OR PAYMENT DISPUTE with their financial institution, credit card company, or any payment processor in connection with any non-refundable booking, deposit, or purchase where the services were booked and confirmed as requested. Passenger(s) acknowledge that initiating a chargeback for non-refundable services constitutes a breach of this Agreement. In the event of an unauthorized chargeback, passenger(s) agree to be held liable for the full amount of the chargeback, plus any fees, penalties, or costs incurred by Fit For a Star Travel as a result of such dispute, including reasonable attorney’s fees.

(e) Travel Insurance Strongly Recommended. Because non-refundable bookings carry significant financial risk, Fit For a Star Travel strongly urges all passengers selecting non-refundable rates to purchase comprehensive travel insurance at the time of booking to protect against covered losses.

5. AGREEMENT NOT TO INITIATE CHARGEBACKS

Passenger(s) expressly agree that they will NOT initiate, authorize, or pursue a credit card chargeback, bank reversal, or payment dispute of any kind with respect to any travel services booked and fulfilled as requested by the passenger(s). This prohibition applies regardless of subsequent dissatisfaction with services delivered by a third-party Supplier, changes in personal travel plans, or any other circumstance not directly attributable to fraud or unauthorized use of the passenger’s payment method by Fit For a Star Travel.

Fit For a Star Travel acts as a sales agent only. When travel services have been booked in accordance with the passenger’s instructions and confirmed by the Supplier, Fit For a Star Travel has fulfilled its obligations. Any disputes regarding the quality, delivery, or performance of services must be directed to the applicable Supplier and/or resolved through the passenger’s travel insurance policy.

In the event that a passenger initiates an unauthorized chargeback against Fit For a Star Travel, the passenger agrees to reimburse Fit For a Star Travel for: (i) the full amount of the chargeback; (ii) any chargeback fees assessed by the payment processor or financial institution; (iii) any administrative costs incurred by Fit For a Star Travel in responding to the dispute; and (iv) reasonable attorney’s fees and legal costs if collection action becomes necessary. Passenger(s) acknowledge that misuse of the chargeback process in connection with legitimately booked travel services may constitute fraud.

6. PASSENGER CONDUCT, BEHAVIOR & CONSEQUENCES

Passenger(s) acknowledge and agree that all cruise lines, resorts, hotels, tour operators, and other Suppliers maintain their own codes of conduct and guest behavior policies. By booking travel through Fit For a Star Travel, passenger(s) agree to comply with all rules, regulations, and codes of conduct established by each Supplier for the duration of the travel experience.

(a) Supplier Authority. Cruise lines, resort management, and other Suppliers retain the absolute right, in their sole discretion, to: refuse boarding or check-in; remove a passenger from a vessel, property, or tour; disembark a passenger at any port or location; or deny services to any passenger whose behavior is deemed disruptive, dangerous, threatening, abusive, intoxicated, or otherwise in violation of the Supplier’s policies or applicable laws. The Captain of any vessel or the management of any resort or hotel property has final authority in all matters relating to passenger safety and conduct.

(b) No Liability for Conduct Consequences. Fit For a Star Travel shall bear absolutely no responsibility or liability for any consequences arising from a passenger’s own behavior or conduct, including but not limited to: removal from a cruise ship, resort, hotel, or tour; denial of boarding or check-in; arrest or detention by local, national, or international authorities; fines or penalties imposed by Suppliers or government agencies; costs associated with alternative travel arrangements necessitated by removal; or any other financial or non-financial loss resulting from the passenger’s actions or conduct.

(c) No Refunds for Conduct-Related Removal. In the event that a passenger is removed, denied boarding, or asked to leave any Supplier’s property or vessel due to behavior or conduct violations, no refund of any kind will be issued by Fit For a Star Travel. Any claims for refund must be directed solely to the applicable Supplier and/or the passenger’s travel insurance provider.

(d) Financial Responsibility. Passenger(s) shall bear full financial responsibility for any costs, damages, fines, legal fees, or other expenses arising from their conduct while traveling, including any costs imposed on Fit For a Star Travel as a result of passenger misconduct. Passenger(s) agree to indemnify and hold harmless Fit For a Star Travel from any claims, losses, or liabilities arising from passenger conduct during travel.

(e) Alcohol & Substance Policy. Passenger(s) acknowledge that Suppliers may restrict or deny service of alcohol and may remove passengers from premises or vessels for intoxication or illegal substance use. Fit For a Star Travel bears no responsibility for any consequences arising from a passenger’s use or misuse of alcohol or substances during travel.

7. PASSPORTS, TRAVEL DOCUMENTS & STATE DEPARTMENT ADVISORIES

(a) Passport Validity. Passenger(s) are solely responsible for ensuring that all travel documents — including passports, visas, identification cards, and any other required documentation — are valid and current at the time of travel. Fit For a Star Travel strongly advises and passenger(s) expressly acknowledge that their passport must be valid for a minimum of six (6) months beyond the planned return date of travel. Many countries will deny entry to travelers whose passports expire within six months of arrival, regardless of the length of the intended stay. Fit For a Star Travel bears no liability for denied entry, deportation, or any other consequence resulting from a passenger’s failure to maintain a valid passport with the required validity period.

(b) Visas & Entry Requirements. Passport and visa requirements vary by destination and are the sole responsibility of the passenger(s) to research, obtain, and maintain. Non-United States citizens may require additional documentation, visas, or entry permits. Children and infants also require all applicable travel documents. Fit For a Star Travel strongly recommends contacting the applicable embassy or consulate of each destination country well in advance of travel to confirm current entry requirements.

(c) U.S. Department of State Travel Advisories. Prior to travel, passenger(s) agree to review the U.S. Department of State travel advisories for all countries included in their itinerary. Travel advisories are available at www.travel.state.gov or by calling the Travel Warnings Section of the U.S. State Department at (202) 647-5225. Passenger(s) acknowledge that it is their personal responsibility to review, understand, and act upon current travel advisories, travel warnings, and entry requirements for their destination(s). Fit For a Star Travel bears no responsibility for any consequences arising from a passenger’s failure to review or heed applicable travel advisories.

(d) Centers for Disease Control. For current health and medical information related to international travel, passenger(s) are encouraged to consult the Centers for Disease Control and Prevention (CDC) at www.cdc.gov/travel or by calling (800) CDC-INFO. Passenger(s) assume full responsibility for compliance with any health-related requirements, including but not limited to vaccination requirements, testing mandates, or health declarations required by destination countries or Suppliers.

(e) Name Accuracy. The name, date of birth, and gender appearing on each passenger’s passport or government-issued ID must exactly match the information listed on airline tickets and all booking records. Passenger(s) are required to immediately review all booking details upon receipt of confirmation. Any discrepancies must be reported to Fit For a Star Travel immediately. Fit For a Star Travel is not responsible for costs, fees, or denied travel resulting from name or document discrepancies.

8. BOOKING ACCURACY & PASSENGER REVIEW RESPONSIBILITY

Passenger(s) are required to immediately and thoroughly review all aspects of their booking confirmation upon receipt, including but not limited to: passenger names, mailing address, date of birth, pricing, airfare details, arrival and departure airports, accommodation information, and organized activities. Please notify Fit For a Star Travel immediately if any omissions or corrections are needed. Passenger(s) voluntarily assume full and sole responsibility for any and all risks and/or costs involved with failure to report errors and/or omissions in a timely manner.

9. HEALTH, SAFETY & DESTINATION CONDITIONS

Fit For a Star Travel has no special knowledge regarding the financial condition of Suppliers, unsafe conditions, health hazards, weather hazards, climate extremes, or the suitability for disabled persons of any portion of any tour or destination. You assume full and complete responsibility for checking and verifying any and all conditions regarding health, safety, security, political stability, and labor or civil unrest at your destination(s). You hereby release Fit For a Star Travel from all claims arising out of any problem covered in this paragraph, and agree to submit all other claims against us within thirty (30) days after the return of your trip.

10. TRAVEL INSURANCE

Travel insurance protection is strongly recommended. As your travel agent, Fit For a Star Travel has a professional responsibility to recommend the purchase of comprehensive travel insurance to protect against risks inherent in travel, including: third-party Supplier default or bankruptcy, trip delay or interruption, trip cancellation, medical emergency transportation and evacuation, repatriation, baggage and personal effects loss or delay, illness, accidental death and disability, and travel accident or sickness medical expenses. PROPER TRAVEL INSURANCE MAY PROTECT YOU FROM FINANCIAL LOSS IN ALMOST ALL CIRCUMSTANCES.

By declining travel insurance, passenger(s) acknowledge and accept full personal liability for any cancellation penalties, damages, medical costs, and out-of-pocket expenses incurred as a result of any covered event that would otherwise have been protected under a travel insurance policy.

If purchasing travel insurance, passenger(s) are urged to thoroughly read the policy’s confirmation of benefits. Fit For a Star Travel has no control over the travel insurance provider or its coverage decisions and is not responsible for policy coverage, claims processing, or the denial of any claims. Travel insurance providers may not be permitted to discuss claims with Fit For a Star Travel due to applicable privacy laws.

11. POWER OF ATTORNEY

As our client, you hereby appoint Fit For a Star Travel, LLC to act as your attorney-in-fact for the purpose of signing all documents necessary to purchase and issue airline tickets, tours, cruises, insurance, and hotel guarantees. You authorize Fit For a Star Travel to process credit card charges for said purchases whenever a booking request is received online, by phone, or by email, and reasonably believed to be from you or someone acting on your behalf. You agree that you will pay for all such purchases and will not hold Fit For a Star Travel responsible for any actions taken pursuant to this power of attorney.

12. GOVERNING LAW & DISPUTE RESOLUTION

You agree that all suits, claims, or disputes in connection with, or incident to, this Agreement shall be litigated, if at all, exclusively in the courts of Horry County, South Carolina, which shall serve as the sole and exclusive jurisdiction for all claims brought by you or by Fit For a Star Travel. You hereby submit to the personal jurisdiction of those courts and agree that this Agreement shall be governed by and construed in accordance with the laws of the State of South Carolina. Any claim not submitted within thirty (30) days of the return of your trip shall be deemed waived.

13. INTELLECTUAL PROPERTY & WEBSITE CONTENT

The content and images contained on the Fit For a Star Travel website, including all downloadable files, are protected by copyright and applicable intellectual property laws. You agree not to use or authorize the use of this information for any purpose other than personal use, and not to engage in resale, redistribution, or commercial use of any content from this website. Third-party links on this website are included solely for convenience and do not constitute any endorsement by Fit For a Star Travel. Fit For a Star Travel is not responsible for the accuracy or content of third-party websites.

14. ACKNOWLEDGMENT & ACCEPTANCE

Both parties agree that you may acknowledge and accept these Terms and Conditions by any of the following means: (a) electronic signature or electronic acknowledgment; (b) handwritten signature; (c) email acceptance; or (d) implied consent through your actions, including without limitation the payment of any invoice or the use of any travel services booked through Fit For a Star Travel or any related Supplier. All such means shall be deemed effective acknowledgment and execution of this Agreement and shall be sufficient to bind the parties to all terms and conditions herein.

REPRESENTATION OF ALL TRAVELERS

The individual submitting a booking request or making payment represents and warrants that they are authorized to act on behalf of all travelers listed on the reservation.
By doing so, you agree that these Terms & Conditions apply to you and to all other travelers on the booking, including minors and travel companions.
You accept full responsibility for communicating all information contained herein to every traveler on the reservation.

BY MAKING PAYMENT FOR ANY TRAVEL SERVICE BOOKED THROUGH FIT FOR A STAR TRAVEL, LLC, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE LEGALLY BOUND BY ALL OF THE TERMS AND CONDITIONS SET FORTH IN THIS AGREEMENT.
